Heard the learned Advocate for the petitioner. 2.

The petitioner who was the Sarpanch of Village Ghosapuri, Taluka and District Beed, is seeking quashment of the Crime No.376/2023 registered with Rural Police Station, Beed for the offence punishable under Sections 406, 409, 420 read with 34 of the Indian Penal Code. 3.

Going by the FIR, the allegations regarding misappropriation by the petitioner who was the Sarpanch and the Gram Sevak are to the effect that pursuant to an enquiry undertaken as per the instructions of the Chief Executive Officer of the Zilla Parishad, a report was submitted. It was revealed that an amount of Rs.2,60,062/- which was traceable to the measurement book regarding the royalty which the petitioner and

968.Cri.Appln.-32-2024.doc the other accused were supposed to credit in Government's account was misappropriated. Particulars about the money misappropriated with details can be found in the FIR.

Since the FIR was lodged pursuant to some internal enquiry, we see no reason at this stage to cause any interference in the investigation, much-less can consider the petitioner's request for quashing it. 5.

The application is rejected.
