Heard the parties for some time.

During the course of argument it is submitted that, now substantive appeal is pending before the authorities against the impugned order. It would be in the interest of justice to direct the parties to prosecute the appeal before the authority. 3.

In the meantime, the petitioner shall deposit an amount of Rs. 33,26,178/- as per the order passed under Section 7Q of the Employees Provident Fund and Miscellaneous Provisions Act. So far as amount of penalty is concerned, it would be sufficient for the petitioner to deposit

2 42-wp 2208-2025.odt 50% of the amount with the authorities within a period of four (04) weeks from today. This deposit shall be without prejudice to the rights of the parties and subject to outcome of the appeal. 4.

With this, the writ petition stands disposed of. No order as to costs.

Needless to say that, the appellate Tribunal shall not insist for further deposit. In case, the deposit is not made, the consequences to follow.
