Heard learned counsel for the applicant and learned A.P.P. for the state.

It has been alleged against the applicant that police had received the secret information that in one Maruti swift Desire unauthorized Ganja was being carried. The police intercepted the car and found contraband. The allegation against the applicant is that the motorbike of the applicant is also intercepted. He stopped the bike and made a statement that swift car was following him and he was giving protection to the car that it should not be intercepted on the road. Only on the basis of this evidence, the applicant has been arrainged as an accused. There appears no satisfactory evidence to prove involvement of the applicant in the said crime. In such

34- B. A. No. 56-2023.odt circumstances, the antecedents to the discredit of the applicant would not come in the way to refuse the bail. Hence applicant deserves bail.

ORDER

(i) The Bail Application is allowed.

(ii) The applicant Vijay Sanjay Thakre, be released on bail on executing P.B. and S. B. of Rs. 50,000/- with one solvent surety in the like amount in Crime No. 170 of 2021 registered with M.I.D.C CIDCO Police Station, District Aurangabad for the offences punishable under Sections 8(c) 20(b)(ii)(c) and 29 of the N. D. P.S. Act, 1985 on the conditions that :- (a) The applicant shall not tamper with the prosecution witnesses and do not avoid the trial for unnecessary reason. ( S. G. MEHARE ) JUDGE ysk
