The petitioners are assailing Rule 4.5 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Undergraduate Medical and Dental Courses) Rules, 2016.

We have heard learned Advocate for the petitioners, learned A.G.P. and learned Advocate Mr. M.D. Narwadkar for respondent No.3. 3.
The issue is no longer res integra. The Division Bench of this court, to which one of us (S.V. Gangapurwala, J.) was party, has, under judgment and order dated 23rd December, 2021 passed in Writ Petition
WP335-349-2022.odt No.12210/2021, dealt with the same issue and held that the said Rule does not appear to be arbitrary or unreasonable. The challenge to the said Rule is negatived.

For the reasons recorded in the judgment and order dated 23rd December, 2021 passed in Writ Petition No.12210/2021, the present writ petitions also stand disposed of. No costs.
