Motion is made for speaking to the minutes / modification of the order dated 22-12-2022 by the original respondent no. 4 which is Nagar Panchayat, Lohara.

Learned advocate Mr. Chavan for the original respondent no. 4 submits that this Court in paragraph no. 3 of the order had directed that the tender process shall not be finalized till the next date but in-fact, even the work order was issued on 02-12-2022. Said fact was not brought to the notice of this Court.

Learned advocate Mr. Saeed Shaikh who represents the original petitioners submits that in spite of the strenuous efforts and

2 CA/ 162 /2023 even applications having been filed under the Right to Information Act, nothing was informed to him about the stage of the tender process. 4.

Be that as it may, the copy of the work order dated 02-12-2022 placed on the record along with this application (Exhibit - A-1) clearly demonstrates that the work order was already issued. In the light of such state-of-affairs, the direction in paragraph no. 3 of the order dated 22-12-2022 shall stand deleted. 5.

The application is disposed of.

The learned advocate for the petitioners submits that in view of the afore-mentioned state-of-affairs, leave may be granted to the petitioners to amend the petition and the prayer clause. 7.

Leave granted. Amendment to be carried within two weeks and the copies of the amended petition shall be furnished to the other side.
