The learned counsel for the applicant produced on record copy of order dated 5.1.2024 passed by the learned Civil Judge, Senior Division, Aurangabad (Corporation Court), Aurangabad mentioning that the Special Civil Suit No. 10 of 2016 filed by present respondent No.1 has been abated since his legal representatives were not brought on record. 2.

Since the original suit is now abated, the present Appeal against the order of remand of that suit has become infructuous.
