By way of the present writ petition, the petitioner is challenging the auction sale under Rule 107 (11)(D-1) of the Maharashtra Cooperative Societies Act 1960 and Rules 1961. The petitioner own an amount of more than Rs. 10 Crores as on today to the respondent No. 2 bank and the certificate under section 101 is issued.

The present writ petition cannot be entertained as no case is made out before this Court to interfere with the order passed by the Collector in execution of the recovery proceedings. In view of the same, the present writ petition is dismissed.
