Civil Application No. 2437 of 2011 in Writ Petition No.1261 of 2002 has been filed by the employer - Maharashtra State Electricity Board for fixing the Writ Petition for final hearing, Civil Application Nos.5578 of 2011 and Civil Application No.728 of 2007 have been filed by the employer also for fixing the Writ Petition No.1261 of 2002 for final hearing. Civil Application No. 9389 of 2008 has been filed by the employer - MSEB against the employee in another Writ Petition No.1346 of 2007 for fixing Writ Petition for final hearing and stay to recovery proceedings. 2.
The employee has filed Writ Petition No. 851 of 2005 seeking backwages and other benefits. While issuing Rule, said Writ Petition has
CA/2437/2011/Group been ordered to be heard along with Writ Petition No.1261 of 2002 by this Court (Coram : S.V.Gangapurwala, J.), on 6.6.2011. 3.
The issue is as regards the respondent, who was engaged, allegedly, for supplying water only during the summer season. He claimed permanency before the Industrial Court by filing Complaint (ULP) No.1277 of 1999 (Old No. 130 of 1996), which was partly allowed by the impugned judgment dated 18.2.2002. Contention is that the said employee has been foisted upon the petitioner.

Learned Advocate for the respondent submits that the petition could be heard finally.

In the light of the peculiar facts of this case, all these four Civil Applications filed by the applicant / employer are disposed off by listing Writ Petition No.1261 of 2002 for final hearing on 16.4.2015. 6.
In the light of the above, Writ Petition No.851 of 2005 and Writ Petition No.1346 of 2007 be listed, along with Writ Petition No.1261 of 2002, for final hearing on the adjourned date. ( RAVINDRA V. GHUGE, J. ) ...
