IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 980 CIVIL APPLICATION NO. 828 OF 2019 IN WRIT PETITION NO. 2216 OF 2016 AMRUTA AMIT CHAVAN

VERSUS

AMIT KAMLAKAR CHAVAN Advocate for Applicant : Ms. Renika Joshi h/f. Ms. R.D. Reddy.

Advocate for Respondent : Mr. S.K. Chavan.

CORAM : RAVINDRA V. GHUGE, J.

Dated : 18.01.2019.

PER COURT :

1.

I have heard the learned advocates for the respective sides.

2.

This Court had passed an order on 31.07.2018, directing the petitioner/husband to deposit an amount of Rs. 75,000/- in this Court. Simultaneously, the respondent/wife was permitted to withdraw Rs. 50,000/- from this Court. 3.

The difficulty voiced is that there is no record of the wife by her marital name. She has no identification documents which would identify her, post marriage. It is, therefore, requested that she may be permitted to withdraw amount in

18CA828.19 her maiden name. Learned advocate for the husband does not oppose.

4.

In view of the above, this Civil Application is partly allowed. The applicant is permitted to withdraw Rs. 50,000/- from this Court by her maiden name Amruta Sanjay Bhelonde. She would make an application for withdrawal along with her recent photograph, recent address proof and her Election Commission Voter ID Card and her advocate would identify her for withdrawal of amount.

5.

The request for transferring the remaining amount of Rs. 25,000/- to her account at Nanded, is refused for the present. The registry would invest the said amount in FDR in a Nationalized Bank of Aurangabad, initially for the period of one year and to be renewed for further periods, subject to the orders passed in the Writ Petition.
