When the matter is called out today, despite orders as are appearing from 8th March, 2010, viz,. 28th October, 2014, 17th March, 2015, 27th August, 2015, 1st October, 2015, 17th November, 2015 and 4th January, 2016, no one has caused appearance on behalf of the appellant or for that matter for respondents. As such, the second appeal stands dismissed for non prosecution.

In view of dismissal of the second appeal, civil application does not survive and stands disposed of.
