Mr. Madde, the learned advocate for the petitioner submits that on the date when the application was filed for the appointment on compassionate ground, the petitioner had not completed 45 years of the age. The relevant date would be the date on which the petitioner' s father died while in service.

Learned AGP appears for respondent No. 1. Mr. Urgunde, appears for respondent No. 2.

We cannot comprehend the situation as in the present case. It is submitted that the father was in service at the time of his death. He may be below 58 years of age and the petitioner completed 45 years of age on 11.01.2020.

Moreover as, admittedly, the petitioner has crossed 45 years of age, the claim of the petitioner can not be considered. 5.

Writ Petition is dismissed. No costs.
