The Appellants / original Plaintiffs have instituted Special Civil Suit No.60 of 1982 for declaration that Plaintiff No.1 is the owner and for restoration of possession and a decree of perpetual injunction against the Respondents / original Defendants. During the pendency of this appeal, though Respondent Nos.1 to 3 are reported to be dead, the Appellants have not taken any steps to bring their legal heirs on record and consequently, by order of the Registrar, the appeal is abated to the extent of Respondent Nos.1 to 3 and presently the appeal is continued against Respondent No.4 alone.
