This is yet another instance wherein litigants are taking liberty in moving this Court under Articles 226 and 227 of the Constitution of India merely for asking without there being any circumstance which otherwise would entitle to litigant to invoke the these powers.

The petitioner is seeking a writ of mandamus directing the Trial Court wherein her suit is pending, to decide it within a stipulated time.

Anticipating the fact, on our query, the learned advocate for the petitioner submits that the petitioner has not moved any

542.25wp (2) application to the Trial Court making out the case for treating her suit exceptional to the normal course and to decide it out of turn. 4.

The writ petition is disposed of with costs of Rs.3,000/- to be deposited by the petitioner in this Court within a period of two weeks, failing which, the Trial Court shall not permit the petitioner to participate in the proceeding.
