Heard learned counsel for the applicant and learned APP for the State.

The alleged muddemal i.e. foreign liquor has been seized from the spot of the incident. The applicant has undergone PCR for sufficient period. Absconding other co-accused may not be a ground to refuse the bail. In view of the facts and circumstances of the case and the investigation made against the applicant, the applicant deserve bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Pralhad Madhu Pawar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.445 of 2022, registered at Nandurbar Taluka Police Station, Taluka

948-ba-67-2023.odt (2) and District Nandurbar for the offence punishable under Section 65 (e) of the Maharashtra Prohibition Act, on the conditions that ; (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the concerned police station as and when called on written notice by the investigation officer, till filing of the charge sheet.

(c) The applicant shall refrain himself from involving in the similar crimes.
