ORDER (Per Ravindra V Ghuge,J) 1.

The Petitioner has directly approached this Court under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus to the Maharashtra State Board of Secondary and Higher Secondary Education, Latur to correct his date of birth. According to him, his actual date of birth is 25/5/1981 and is recorded in the S.S.C. Certificate as 25/12/1982. He does not intend to reduce his age. 2.

The learned Counsel for the Board submits that,

the Petitioner should approach the Education Officer under Rule 26(4) of the Secondary School Code for correction in the date of birth. Learned Counsel for the Petitioner responds, by stating that he would withdraw this Petition and move such application.

Considering the above, since we are of the impression that, there is an obvious mistake, which could be covered by the reported judgment of the Full Bench of this Court in the case of Janabai Himmatrao Thakur Vs. The State of Maharashtra & Ors. (Writ Petition No.8085/2017), decided on 17/10/2019. The same be considered pragmatically within a period of 30 days from the date of the filing of the application. With the above observations, this Petition is disposed off as withdrawn.
