The grievance of the petitioner is that the encroachment is on the public road. The representations are given from time to time to respondent nos.1 to 4. However, no action is taken. The Divisional Commissioner had also directed Chief Executive Officer to enquire about the encroachment. However, Chief Executive Officer also not taken any action.

We have heard the learned counsel for the petitioner and learned counsel for respondents also.

The petitioner has filed representation on 20.04.2017 to the Divisional Commissioner who in turn has referred it to the Chief Executive Officer. The Chief Executive Officer and/or the Block Development Officer shall consider the representation of the petitioner and after hearing respondent no.5, the petitioner and the interested parties shall take decision upon the same expeditiously and preferably within a period of six

(06) months.

Writ Petition is disposed of. No costs.
