Heard learned Counsel for the petitioner. The limited grievance raised in this petition is that though the petitioner has filed application on 21.04.2017 (Exh. "D") under Rule 61 (1) of the Maharashtra Minor Minerals Extraction (Development & Regulation) Rules,2013, however yet the application has not been decided.

We direct respondent No.2 to decide the said application expeditiously, if already not decided, on its own merits and after following relevant procedure, within four weeks.

The writ petition is disposed of in above terms. 5.

We make it clear that we have not entered upon merits of the contentions raised in the petition. It is for respondent No.2 to decide the said application on its on merits.
