IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD SECOND APPEAL NO.559 OF 2019 WITH CA/16676/2022 IN SA/559/2019 ARCHANA SANDEEP KAPSE

VERSUS

SANDEEP EKNATH KAPSE ...

Advocate for Respondent : Mr. M.M. Bhokrikar ...

CORAM : S.G. MEHARE, J.

DATED : DECEMBER 01, 2023 PER COURT:- 1.

None present for the appellant.

2.

Learned counsel for the respondent placed on record the compromise deed and the order of the learned Judicial Magistrate First Class, Gevrai dated 15.03.2023. Both parties admitted the compromise; hence, the Court received it on record. The terms of the compromise reveals that the appellant admitted the decree of divorce granted in favour of the respondent. It was also agreed that the present second appeal would also be withdrawn. The compromise deed is a certified copy.

3.

The appellant and her counsel are absent. Probably, she might have lost the interest in the appeal as she has settled the dispute amicably before the Court. Believing the contents of the compromise deed dated 06.03.2023 accepted by the Court on 15.03.2023, the appeal stands dismissed for non-prosecution.
