The Petitioners have challenged the judgment and order dated 02.05.1994 delivered by the School Tribunal, Aurangabad in Appeal No.138/1991, by which the oral termination of the Respondent No.1/ original Appellant dated 19.08.1991 has been set aside and she has been granted reinstatement on the post of Primary School Teacher. This petition has been admitted by order dated 17.06.1998. Rule is expedited.

Learned Advocate for the Petitioner/ Management submits

*2* 920.wp.2102.94 that the concerned School has been permanently closed down long ago and this matter is rendered infructuous. It is, therefore, prayed that this matter be disposed of as infructuous.

Mr.Barlinge, learned Advocate for the Respondent No.1, submits that he has no instructions as regards permanent closing down of the Petitioner School.

In the light of the statement made on instructions by the Petitioners' Advocate, this Writ Petition is disposed of as infructuous. Rule is discharged.
