Heard learned counsel for the applicant. He invited attention of this Court to the copy of the agreement dated 25th of November, 2010.

The petitioner claims that the notice has been issued to the respondent so as to settle the monetary dispute which has arisen out of the grounds of the agreement. However, the respondent has refused to accept the same.

In view of above, the present application is moved for appointment of Arbitrator.

As the contents in the application are not controverted by the respondent, it will be appropriate, in my opinion, to appoint Arbitrator and accordingly, Mr. (Dr.) S.D.Tawshikar, Advocate is appointed as Arbitrator. 6.
