Learned counsel for the applicant refers to reasons on account of which the delay has been caused viz. immobility of applicant due to old age and the distance.

Learned counsel for respondent no.2 purports to resist, but is not in a position to challenge the veracity of the reasons given for condonation of delay.

Delay is of about 112 days. In the circumstances, it would be expedient in the interest of justice, to condone the delay.
