The petitioner is merely aggrieved by the fact that his appeal preferred under Section 247 of the Maharashtra Land Revenue Code, 1966 is not being decided expeditiously.

Learned AGP submits that the post of Appellate Authority, though not vacant; in the sense that some other officer has been given the charge, he cannot undertake the inquiries in the appeals. 4.

With the hope that, some-one assigned with the powers to decide the appeals would be appointed, we dispose of the writ petition, with a direction to the respondents that as soon as either the powers are conferred on the existing in-charge appellate authority, or some-one else

{2} 25 sr.no..odt having the powers would be posted, the petitioner's appeal would be decided as expeditiously as possible and in any case, within a period of twelve weeks from taking over the charge by the appellate authority or posting, as the case may be.
