1] Learned counsel for the respondent places on record Government Resolution dated 18th October, 2016, whereunder, the State Government has issued clarification in respect of applicability of Shetti Commission Pay Recommendations. The Government Resolution has been issued in pursuance to the directions issued by this Court in W.P. No. 429 of 2015 Amanullah Khan S/o. Amir Khan Pathan Vs. State of Maharashtra decided on 13.8.2014. The State has taken decision to make applicable the pay scales prescribed by the Government Resolution to the Superintendents and Assistant Superintendents, functioning in the District and Sessions Courts and Courts subordinate thereto forming part of the District Judiciary. 2] Copy of the Government Resolution is taken on record and marked "X" for the purpose of identification. In view of the Government Resolution dated 18.10.2016, the grievance raised by the petitioner in the instant petition stands redressed.

{2} 1003.16 wp.odt 3] Writ petition is accordingly disposed of. Respondents are directed not to effect recovery of the amount directed under order dated 30th July, 2015. As a consequence of the decision taken by the State Government, the pay scale applicable to the petitioner shall have to be refixed and the respondents shall take appropriate steps in that regard, as expeditiously as possible, preferably within a period of six months from today.
