Learned Advocate for the Petitioner submits that, in view of the disposal of Civil Suit No. 102 of 2005 and subsequent proceedings in the nature of a Second Appeal, which is pending in this Court after the remedy of First Appeal was exhausted, this Petition has become infructuous and same may be disposed off, with liberty to file an appropriate application before the appropriate authority if the Second Appeal is allowed in his favour.

In view of the above submissions made by the learned Advocate for the Petitioner, the Writ Petition stands disposed off as infructuous.
