The learned Counsel for the petitioner submits that, the validation proceedings is pending. The petitioner is placed on supernumerary post only on the ground that the validity certificate is not submitted. To get the proceedings decided within the stipulated period is not in the hands of the petitioner. 2.

It is further submitted that, the vigilance is conducted. The petitioner has filed reply to the vigilance report and hearing has also taken place, but the orders have not been passed. 3.

The Respondent / Committee shall endeavour to decide the validation proceedings within three months from the date of appearance of the petitioner.

The petitioner shall appear before the Committee on 06-09-2021.

The impugned order placing the petitioner on supernumerary post during pendency of the validation proceedings is quashed and set aside.

Respondent no.3 may take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceedings.
