On 11.02.2016, I had recorded the statements of Mr. Salve, learned Counsel for the Respondent No.1. Paragraph Nos.1 to 4 of the order dated 11.02.2016 read as under: "1) This matter is on the final hearing Board.

2) None appears for the petitioner.

3) Mr. H.M. Salve, learned Advocate appearing on behalf of the contesting respondent i.e. the respondent no.1, submits that the matter has been amicably settled between the parties as the respondents have already received the possession of the two suit plots. The issue has, therefore, been resolved between the parties way back in the year 2003. He further submits that this petition can be disposed of by recording his statement.

4) In the light of the above, by recording the statement made on instructions by Shri Salve, this petition is posed on 12.2.2016 for passing orders." 3.

I had posted this matter today in order to enable the petitioner to appear before this Court and confirm the statements made by Mr. Salve. However, none is appearing for the petitioner. 4.

In the light of the above and the statements made by Mr. Salve, learned Counsel which have been recorded on 11.02.2016, 2 / 3

this petition is disposed of as being infructuous. Interim relief stands vacated. Rule is discharged.
