Delay, for the reasons contained in civil application, stands condoned since the application has been moved immediately within prescribed period after learned counsel Mr. A. M. Gaikwad for respondent no. 1 informed about death of respondent no. 1 to learned counsel for applicant - appellant.

Civil application, as such, is granted in terms of prayer clauses (B), (C) and (D) and is disposed of.

Learned counsel for the applicant-appellant states that consequential amendments in the cause title of the appeal would be

CA-2486-18.doc carried out within one week. On such amendments being carried out, notices be issued within a period of two weeks thereafter to legal representatives of deceased respondent no. 1 for bringing them on record.

Learned counsel Mr. A. M. Gaikwad states that he will file power on behalf of legal representatives of respondent no. 1 brought on record.
