The petitioner has already filed appeal challenging fine and penalty. The seizure of the vehicle is by the Tahsildar, who had the authority at the relevant time also.

As the petitioner has already filed an appeal, in the appeal the petitioner can make an application for release of the vehicle. If such an application is made, the appellate authority shall take decision upon the said application within a period of 30 days. 3.

With the aforesaid observations, the writ petition is disposed of. No costs.
