The petitioners pray that an application for one time settlement (OTS) tendered by them to a private society namely Shri Swami Samarth Gramin Bigar Sheti Sahakari Patsanstha Maryadit, be considered by the said society.

We have specifically asked the petitioners as to whether any Government Officer is a member of the committee, which has to take a decision on the OTS. The answer is that, there is not a single Government Official in the said committee and it is solely a private society, which has to take a decision.

Considering our writ jurisdiction and the effect of Article 12 of the Constitution of India, this petition cannot be entertained.

The learned advocate for the Petitioner submits on instructions, that he desires to withdraw the petition with liberty to avail a statutory remedy.

As such, this petition is disposed off as withdrawn. Needless to state, the petitioners are at liberty to avail of a remedy as may be statutorily provided.
