This petition was admitted on 16/12/1994. An interlocutory order passed below Exh.U-2 dated 12/10/1994, by which the application for interim relief was allowed by the Industrial Court and the respondent employee's service was protected till issuance of show cause notice, has been challenged in this petition. 2.

Interim relief was granted by this Court in terms of prayer clause "C" by which the impugned order was stayed. 3.

The petitioner has in fact challenged merely the issuance of show cause notice and an ex-parte ad interim protection. khs/Aug. 2015/3843-94-d

Mr.Pokharkar, learned Advocate for the petitioner submits that the said society has been closed down in 2011. Mr.Upadhye contradicts the said statement.

Considering the above, I deem it proper to permit the Industrial Court to proceed in deciding Complaint (ULP) No.330/1994, if as yet it is not decided, as expeditiously as possible and preferably on or before 30/01/2016.

Needless to state, in the event the complaint is still pending, the litigating sides shall co-operate with the Industrial Court and shall refrain from seeking adjournments on unreasonable or trivial grounds keeping in view that the complaint is instituted in 1994. 7.

The petition is, therefore, disposed of with the above directions and Rule is, accordingly, discharged.
