The proposal tendered by the petitioner seeking permission to operate secondary school in the year 2008 has not been considered. As such, the petitioner is seeking directions to the respondents for consideration of the said proposal. The proposal tendered by the petitioner in the year 2008 need not be directed to be considered in view of change in policy and implementation of the provisions of Right to Education Act.

It would be open for the petitioner to tender fresh proposal as and when respondent authority issues an advertisement and

If the petitioner tenders application in response to an advertisement or an invitation by the respondents for operating secondary school, the same shall be considered at appropriate stage in accordance with the provisions of law. With these directions, the writ petition stands disposed of.
