The petitioner is awaiting recovery to be made pursuant to the order of the learned Judicial Magistrate First Class, Aurangabad purportedly pass under Section 421 of the Code of Criminal Procedure, without even making any effort to pursue the matter and exercise its powers under the Code of Criminal Procedure so that the recoveries are made.

The writ petition is disposed of granting the petitioner liberty to move the Court of Magistrate concerned.
