PER COURT :- This petition was actually filed in 1990 at Mumbai. After transfer, it is shown to be of 1996.

An inter-locutory order below Exhibit 5, dated 4.10.1990, has been challenged. By way of ad-interim relief, the impugned inter locutory order was stayed and liberty was granted to the appellate Court to decide Civil Appeal No.121 of 1990.

Learned counsel for the petitioner is not aware about the present status of the matter.

None appears for the contesting respondents.

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 2006 OF 1996 In view of the above, this petition is disposed off. In the event Civil Appeal No.121 of 1990 has still not been decided, the interim relief granted in favour of the petitioner would continue till 31.12.2018 and the appellate Court, Dhule shall decide Civil Appeal No.121 of 1990 in any case, on/or before 31.12.2018 and shall not seek an extension of time.

Needless to state, if the said Civil Appeal is already decided, the interim protection granted by this Court would merge in the decision of the appellate Court.
