The applicant/appellant has been convicted for the offences punishable under Sections 353 and 323 of Indian Penal Code and sentenced to undergo S.I. for one month and three months, respectively, for said offences, in default, to pay fine of Rs.1,000/-. The trial Court had suspended the sentence of imprisonment until filing of appeal.

Considering the quantum of sentence imposed and the fact that the appeal is not likely to come up for hearing in near future, during pendency of appeal, the substantive sentence of imprisonment stands suspended.

During pendency of appeal, the applicant/appellant be released on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. 5.

The application stands disposed of.
