Challenge in this petition is to the order dated 4th February, 1999 issued by the Desk Officer of respondent No.1 - State thereby granting permission to respondent No.4 to transfer his country liquor shop from Chinchkhed, Taluka-Ambad, District - Jalna to Ambad, District-Jalna.

While granting Rule, by order dated 7th May, 1999, interim relief was refused to the petitioner by a speaking order. 3.

Learned advocate for respondent No.4 states that pursuant to the order of transfer, the shop was transferred in the year 1999 and is being run at the transferred place since last more

After hearing the learned advocate for the petitioner, learned advocate for respondent No.4 and the learned Assistant Government Pleader and taking into consideration the fact that the country liquor shop is being run at the transferred place since last more than 24 years, this Court is of the considered view that the challenge raised in the present petition must fail. Even on merits, no case is made out by the petitioner to interfere in the impugned order, in the extraordinary writ jurisdiction.

In the circumstances, writ petition is dismissed. Rule discharged.
