The present petition is filed against the order passed by the Family Court granting interim alimony of Rs.5000/- per month to the wife.

Mr. Latange, learned counsel for the petitioner submits that the first wife of the petitioner has died. The petitioner has one son and one daughter from the first wife. The petitioner also has to maintain his age old parents. The agricultural land owned by the petitioner is non-irrigated. No other source of income exist. Even, for treatment of first wife, the petitioner had to shell out large sum of money. The petitioner is ready to cohabit with the respondent. The matter can be sent for mediation. The petitioner has deposited the interim maintenance amount granted.

The present matter is against an order granting interim maintenance of Rs.5000/- per month.
In these days grant of Rs.5000/- maintenance per month would not be a large sum. It has come on record that the petitioner has agricultural land and also the petitioner is doing the business of supply of building material. The said fact is admitted by him.

Considering all these aspects, award of Rs.5000/- per month as maintenance is not unreasonable. More over, the petitioner in Family Court can explore the avenue of mediation and reconciliation. 5.
Writ Petition accordingly stands disposed of. No costs.
