This writ petition is originally filed in 1993 at the Principal Seat of the Bombay High Court, bearing Writ Petition No. 1317/1993, arising out of judgment and order dated 21st January 1993, passed by learned Additional Sessions Judge, Dhule, dismissing the appeal filed by the tenant against the decree for eviction passed by the learned 5th Joint, Civil Judge, Senior Division, Dhule in Regular Civil Suit No. 285/1984, by judgment and order dated 10th December 1985. The matter stood transferred in 1996 to the Aurangabad Bench and was given a new Ethape

After transfer, this Court issued notice to the petitioners and the respondents as well. It is seen that the petitioner Nos. 1A and 1D are served. This Court, thereafter, again re-issued notice to petitioner Nos. 1B and 1C and by order dated 22nd March 2012. However, the said notice is returned unserved with remark "not residing on given address". 3.

Inspite of service, none appears for petitioner Nos. 1A to 1D. The address of petitioner Nos. 1B and 1C is not found. 4.

Today, the learned Advocate for respondent Nos. 1 and 2 informs that notice to respondent Nos. 1 and 2 is not issued. Since no steps are being taken for a long time, this Court finds that keeping the petition pending is of no use. It needs to be dismissed for default. 5.
