The petitoners are aggrieved by the enquiry being conducted by the respondnet no. 5 - Tahsildar on a complaint filed by the respondent no. 6 wherein a notice to show cause has been issued to them in a proceeding under section 48(7) of the Maharashtra Land Revenue Code, 1966. It is apparent that the petitioners have even replied the notice on 02-01-2023. It would be premature for this Court to now embark any scrutiny of facts and to reach a conclusion that could have a bearing on the final order to be passed by respondent no. 5 - Tahsildar.

True it is that the Tahsildar - respondent no. 5 has apparently addressed a letter to the Sub Divisional Officer, Pachora touching the various aspects of the allegations and the enquiry being

2 WP / 466 / 2023 conducted by him. There is nothing for us to reach a conclusion that he would overlook this correspondence at page 66, the letter dated 07-12-2022.

We dispose of the writ petition with a hope that the respondent no. 5 will pass appropriate order, on passing of which it would always be open for the petitioners to impugn it if it goes against them.
