The petitioners are objecting to the order passed by the District Deputy Registrar, Parbhani in making the appointment of the Single Member Inquiry Committee for conducting inquiry as regards the allegations levelled against the Management of the Agricultural Produce Market Committee. The petitioners contend that the District Deputy Registrar is not vested with the powers to appoint the Single Member Inquiry Committee and these powers are to be exercised by the State Government.

The contentions raised by the petitioners are
{2} 902WP446-18 controverted by the respondents by presenting affidavit in reply on behalf of respondent No.2, wherein it is contended that the powers to be exercised under sub section (4) of Section 57 of the Maharashtra Agriculture Produce Marketing (Development and Regulation) Act, 1963 have been delegated to the District Deputy Registrar, Cooperative Societies. In this view of the matter, the order challenged in the instant writ petition does not call for interference.

Considering these contentions, there is no substance in this writ petition. According to us, the grievance raised in the instant writ petition does not deserve to be considered. Hence, the writ petition stands disposed of. No costs. ( A.M.DHAVALE ) ( R.M.BORDE ) JUDGE JUDGE mta
