Issue is as regards closing of the liquor shop and the nonrenewal of the license. Learned AGP places on record copy of the communication dated 21.6.2017 from the Superintendent of the State Excise Department, Dhule indicating that the shop of the petitioner falls within 500 meters of the State/National high way and as such, his license has not been renewed from 1.4.2017. The letter is marked 'X' for identification.
Considering the above, I find that this petition is rendered infructuous. Same is, therefore, disposed of being infructuous. Rule is discharged.
It is, however, made clear that the disposal of this petition shall not be an impediment for the petitioner to move a proper Application under the Rules applicable for seeking a license for operating the liquor shop or for relocating the said shop. In the event, such an application is filed, the concerned department shall deal with the same on its own merit.
