DATED : 4TH JANUARY,2016 PER COURT :- Heard Shri Khandare, learned counsel for the petitioner. 2] Submission is made that while condoning the delay of 245 days, no cogent and sufficient reasons are assigned by the learned First Appellate Court. It is further submitted that without there being any sufficient ground or documents placed on record, delay has been mechanically condoned. I have perused the impugned order. The order reveals that certain documents were filed on record by the appellant before the first appellate Court in support of his contentions raised in the memo of appeal and the first appellate Court has observed that it do not see any reason to disbelieve the documentary evidence on record.
3] In view of above, I am not inclined to cause any interference in the order so passed. The learned counsel has alternatively prayed for direction to the first appellate Court to expeditiously dispose of the Appeal. In view of above, following order.
wp5367.15 -2Writ Petition stands rejected. The first appellate Court is however, directed to decide the appeal pending before it, expeditiously.
