The learned counsel for the applicant tendered across the bar status report as directed under order dated 13/10/2022. On perusal of said status report it is evident that the matter which was sought to be transferred in the main application i.e. Marriage Petition No. 321 of 2018 is still pending for disposal according to law.

Heard rival submissions.

The applicant wife is seeking setting aside of the order dated 25/10/2018 passed by this court according to which the MCA No.216 of 2018 stood dismissed for want of removal of offce objections. There is also delay of 38 days.

The learned counsel for the respondent husband strongly opposed the application.

The learned counsel for the applicant undertakes to remove all the offce objections within two weeks. As such, following order is passed.

ORDER

1.

Application is hereby allowed in terms of prayer clause B and C subject to removal of all the offce objections in respect of MCA No. 216 of 2018 within two weeks from the date of this order.

2.

Application is accordingly disposed of.
