The learned advocate for the respective sides jointly tender a copy of the judgment of this Court dated 11.12.2014 delivered in the case of the Estate Manager, Maharashtra State Farming Corporation Ltd. Vs. Shri Jagannath Raghoji Sonwane in W.P. No. 2670 of 2001. It is stated that in identical set of facts, this Court has allowed the petition in terms of prayer clause (B) and the said judgment would be squarely applicable to this case.

In view of the above, this petition is allowed in terms of prayer clause (B), which reads as under :-

911 - WP 614 - 02 "(B) By issuing a writ of Certiorari or any other writ in the nature of writ of certiorari the order of the Industrial Court, Ahmednagar dated 30.11.2001 in Revision (ULP) 22 / 2001 and the judgment and order dated 09.03.2001, passed by the Labour Court, Ahmednagar in Complaint (ULP) No. 102 / 1999 may kindly be quashed and set aside."

Rule is made absolute accordingly.
