Learned counsel for the petitioner states that the petitioner would approach the Court of Magistrate by preferring an application for directions to the Police officer to investigate the offence under Section 156 (3) of the Criminal Procedure Code. He seeks permission to withdraw this petition with such liberty.

Permission is granted. The petition is allowed to be withdrawn. The petitioner is at liberty to move before the Magistrate. If such application is preferred, it shall be decided on its own merits, in accordance with law.
