This matter was not on the Board today. A motion was moved at 10:30 AM requesting for taking this petition on the Production Board as the Petitioners desire to withdraw this petition. Hence, the matter is taken on the Production Board.

The learned Advocate for the Petitioners submits, on instructions, that since the impugned order dated 31.12.1993 will have to be assailed as per the statutory remedy available, the Petitioners pray for withdrawal of this petition so as to avail of a statutory remedy and time spent by the Petitioners in this Court, may be treated as a good ground for condonation of delay, if any.

*2* nobwp3516o94 Considering the above, this Writ Petition is disposed of as withdrawn with liberty to the Petitioners to resort to a remedy as may be permissible in law. In the event of delay and there being a provision for condonation of delay, time spent by the Petitioners in this Court from 11.10.1994 till today, shall be a good ground to be considered for condonation of delay.

Rule is discharged.

The pending Civil Application, if any, does not survive and stands disposed of.
