The learned advocate for respondent nos.2 and 3 CIDCO Authorities, submits that the permission to transfer was not granted as the petitioner was duty bound to submit an occupancy certifcate issued by the Planning Authority, which is the Aurangabad Municipal Corporation. Copy of the occupancy certifcate dated 01.08.2019 is delivered to the learned advocate for CIDCO on the last day which is 29.11.2021. The learned advocate further submits that the CIDCO will peruse the original occupancy certifcate to verify the copy and would return the original certifcate to the petitioner and keep the photostat copy on record and issue the order permitting transfer of the plot. 2.

In view of the above, this petition is disposed of with the following observations :- a) The petitioner would approach the ofce of CIDCO at the 1/2

909-wp-934-2020.odt Jalgaon Road address tomorrow by 03.00 pm and show the original occupancy certifcate.

b) The CIDCO Authorities would compare the said original certifcate with the photostat copy tendered and on satisfaction, return the original to the petitioner.

c) CIDCO Authorities shall then issue the NOC for transfer, on or before 24.12.2021.
