Leave to add employer as party respondent. Issue notice to the added party. The learned Additional Government Pleader waives notice for the added party respondent. So also leave to amend the prayer clause.

The learned counsel for the petitioner submits that, the petitioner is serving with the Woman and Child Development Department. The employer has asked the petitioner to submit the validity certificate or else adverse action would be taken. The learned counsel submits that, the caste claim of the petitioner is referred to the Committee on 09th August, 2016. The vigilance is also conducted.

We have heard the learned Additional Government Pleader for the respondents.

In view of the fact that validation proceedings in respect of caste claim of the petitioner is pending and also the fact that, vigilance has been conducted, we pass following order. 6.

The Committee shall decide the caste claim of the petitioner expeditiously and preferably within eight (08) months from today. The petitioner shall co-operate in expeditious disposal of the proceedings. Till the said proceedings are decided, the respondent/employer shall not take any adverse action against the petitioner only on the ground that validation proceedings are pending. Of course, the respondent/employer is at liberty to take further course of action in tune with the judgment delivered by the Scrutiny Committee in the validation proceedings.
