By the present application under Section 439 of the Code of Criminal Procedure, the applicant seeks his release on bail, in connection with C.R. No.286 of 2016, registered with MIDC police station, Jalgaon, Dist. Jalgaon, for offences punishable under Sections 307, 326, 324, 452, 504, 506 read with Section 34 of the Indian Penal Code. 3.

It is the case of the prosecution that the applicant assaulted the complainant along with main accused Suresh and other co-accused with iron rod and knife.

The investigation in the matter is over and charge-sheet is already filed. The statements of eye-witnesses, injury certificate i.e. medical evidence and other material on record prima facie depicts involvement of the applicant in the crime in question.

In view thereof, no case for bail is made out. Criminal Application, therefore, stands rejected.

In case if charge is not framed within a period of six months from today, the applicant will be at liberty to apply afresh. (N. W. SAMBRE, J.) amj
