The application is filed for bail. Both the sides are heard.

The learned counsel for the applicant submitted that the applicant is behind bar since 28th November, 2014, the date of incident. This Court has perused the papers of investigation. There is no allegation that there are bad antecedents against the applicant.

It appears that on the date of the incident information was received by police that some robbers were present at a particular place. While doing

-:(2):- patrolling duty the police went towards that side. After seeing the police, the persons, who had gathered there, started running away. Police could intercept some of the persons, including the present applicant. There is allegation that the articles like one nylon bag, two iron strips were found. A crime came to be registered for offence under section 399, 402 of I.P.C.

In view of the nature of allegations and aforesaid circumstance, this Court holds that it is not desirable to keep the applicant behind bars, as it is not certain as to when the trial will be completed.

The application is allowed. The applicant is to be released on bail on his furnishing P.R. and S.B. of Rs.15,000/-. He is not to tamper with the prosecution witnesses. He is not to commit similar offence. [T. V. NALAWADE, J.] Dt.02/02/2015 ans/129
