Mr.Mayure, learned counsel appearing for the petitioners seeks to withdraw this petition with liberty to file an appropriate application before the Civil Judge,S.D. Aurangabad duly supported by an affidavit of the plaintiff.

Liberty, as prayed for, is granted. However, it is made clear that the application, if any, filed by the plaintiffs for amendment of the plaint, duly supported by an affidavit of the plaintiff, would be examined by the Trial Court on its own merits. 3.

Petition stands dismissed, as withdrawn, with the aforesaid liberty.
